This End User License Agreement ("Agreement") is entered into by and between the individual end user ("You" and "Your") and HeyEVA, a Limited Liability Corporation incorporated under the laws of the State of Texas. This Agreement governs Your access to and use of the HeyEVA Beta Software ("Software") as part of a limited Pilot Project conducted in collaboration with [Facility Name] ("Facility").
By installing, accessing, or using the Software, You agree to be bound by the terms of this Agreement.
Subject to the terms of this Agreement, HeyEVA grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for personal, non-commercial evaluation purposes during the beta testing period. This license is granted only for the duration of the Pilot Project, as contracted with Facility. Use of the Software following the completion of the Pilot Project is not permitted.

The Software and all related materials, features, and feedback opportunities are confidential and proprietary. You agree not to share, publish, post, or otherwise disclose any part of the Software—including screenshots, videos, or documentation—without express written permission from HeyEVA. This obligation survives the termination of the Agreement into perpetuity.
You may be invited to submit feedback, comments, or suggestions about the Software. All such feedback shall become the sole and exclusive property of HeyEVA. You assign all rights, title, and interest in such feedback to HeyEVA and agree that HeyEVA may use, modify, or incorporate the feedback into its products, services, or marketing materials without restriction, compensation, or attribution.

This Agreement is effective as of the date You begin using the Software and will continue until the earlier of:
HeyEVA reserves the right to suspend or terminate Your access at any time without notice, particularly in the case of a violation of this Agreement.
The Software is pre-release and may include bugs, glitches, and incomplete features. HeyEVA may provide periodic updates during the testing period, which may be installed automatically without notice. While limited support may be offered, HeyEVA makes no guarantee of continuous functionality or full technical assistance during the testing period.
The Software, including all content, underlying technology, user interfaces, and associated documentation is the exclusive property of HeyEVA. Nothing in this Agreement grants You ownership of the software or its components.
The Software is provided "as is" without warranties of any kind. We make no guarantees about the accuracy, reliability, availability, or performance of the Software.
To the fullest extent permitted by law, HeyEVA is not liable for any indirect, incidental, special, or consequential damages resulting from Your use or inability to use the Software, including but not limited to data loss, device malfunction, or personal injury.
You agree to indemnify and hold harmless HeyEVA, its operators, developers, and partners from any claims, losses, damages, liabilities, or legal expenses arising out of Your use or misuse of the Software or breach of this Agreement.
HeyEVA may modify this Agreement at any time. Updates will be communicated through facility staff or posted within the Software itself. Continued use of the Software after changes constitutes acceptance of the revised agreement.
HeyEVA maintains a Privacy Policy which is available on its website (www.heyeva.ai) or upon request. The Policy establishes HeyEVA's privacy and data security commitment to users and provides other important information.
By using HeyEVA software, you agree to the terms and conditions specified in Privacy Policy.
By using the Software, You acknowledge that You have read and understood this Agreement and agree to be bound by its terms.
